Terms of Service

These Terms of Service ("Terms") govern your access to and use of GhostLogic Forensics ("GhostLogic," "we," "us," or "our") platform, services, and related products. By using GhostLogic, you agree to these Terms. If you don't agree, don't use the service.

1. Acceptance of Terms

By accessing or using GhostLogic, you agree to be bound by these Terms and our Privacy Policy. If you're using GhostLogic on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

GhostLogic provides forensic evidence collection, storage, and analysis tools designed to capture and preserve digital evidence during security incidents. The service includes:

• Endpoint collectors that monitor and capture system events
• Cloud-based storage and processing infrastructure
• Analysis tools and timeline reconstruction capabilities
• API access for integration with existing security tools
• Dashboard and reporting interfaces

3. Account Registration

To use GhostLogic, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree to use GhostLogic only for lawful purposes. You will not:

• Deploy GhostLogic on systems you don't own or have authorization to monitor
• Use the service to violate any applicable laws or regulations
• Attempt to gain unauthorized access to other users' data or accounts
• Interfere with or disrupt the service or servers
• Use the service to collect, store, or transmit malicious code
• Reverse engineer, decompile, or attempt to extract source code (except for open-source components)
• Resell or redistribute the service without authorization

5. Your Data and Privacy

GhostLogic processes forensic data you collect from your systems. You retain all ownership rights to your data. By using the service, you grant us permission to:

• Store and process your data to provide the service
• Use aggregated, anonymized data to improve the service
• Access your data when necessary for support or security purposes

You are responsible for ensuring that your use of GhostLogic complies with all applicable privacy laws and regulations, including obtaining necessary consent from individuals whose data you collect.

6. Service Level and Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The service is provided "as is" without warranties of any kind. We reserve the right to:

• Modify, suspend, or discontinue any part of the service
• Impose usage limits or restrictions
• Perform scheduled and emergency maintenance

For paid plans, we commit to service level agreements as specified in your contract.

7. Payment Terms

Paid features require payment in advance on a quarterly basis unless otherwise agreed in writing. You agree to:

• Provide current, complete, and accurate billing information
• Pay all fees associated with your selected plan
• Accept responsibility for all charges incurred under your account

We do not offer refunds for prepaid quarters except where required by law. Prices may change with 30 days' notice to active customers.

8. Data Retention and Deletion

You control how long evidence is retained in your GhostLogic account. When you request deletion or when your account is terminated, we will delete or anonymize your data in accordance with our Privacy Policy and your contract, except where:

• Required by law to retain certain records
• Needed for ongoing legal proceedings
• Part of aggregated, anonymized datasets

9. Intellectual Property

GhostLogic and its open-source components are protected by copyright and other intellectual property laws. Our proprietary features and services remain our property. Open-source components are licensed under their respective licenses (MIT, Apache 2.0, etc.).

10. Limitation of Liability

To the maximum extent permitted by law, GhostLogic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, or other harmful code transmitted through the service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

11. Indemnification

You agree to indemnify and hold harmless GhostLogic from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Your deployment of GhostLogic on unauthorized systems

12. Termination

We may suspend or terminate your access to the service at any time if you violate these Terms. You may terminate your account at any time by contacting us. Upon termination:

• Your right to access and use the service immediately ceases
• We may delete your data in accordance with our retention policies
• You remain liable for all charges incurred prior to termination

13. Changes to Terms

We may modify these Terms at any time. We'll notify you of material changes via email or through the service. Your continued use of GhostLogic after changes take effect constitutes acceptance of the new Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Detroit, Michigan, except where prohibited by law.

15. Open Source Licenses

The GhostLogic Community Edition is open source and licensed under the MIT License. Certain proprietary features and hosted services are not included in the open-source release and remain subject to these Terms.

16. Export Compliance

GhostLogic may be subject to export control laws. You agree to comply with all applicable export and re-export restrictions and will not use the service in any country subject to embargo or in violation of any export law.

17. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver. These Terms constitute the entire agreement between you and GhostLogic regarding the service.
